Odd mail message behavior quirk

Okay, this has been bugging me for a while but whenever I get a new message, I'd go in to open the first message on top but it'd always open the next message below it. The only way that I can open the topmost message is if I go to the next message down, open it, then go back to the topmost message. This is with my AT&T branded 9700 with the .296 OS that came with the phone. I'm wondering if upgrading it to the .351 beta OS will fix this quirk.
